Contract & Health Warranty

 

This Agreement is between (Seller) Jamie Roesler and:

It is agreed between the Seller and Buyer as follows: 

1. DESCRIPTION OF DOG
The dog sold to the above Buyer according to the terms of this agreement is:

Sire: Roesler’s Walkin’ the Line            Dam: Roesler’s Whistlin’ Dixie

2. CONDITIONS OF SALE
The Seller guaranteed that at the time of transfer, the dog is in good health.  Should the dog be found in poor health of a serious nature, Seller will refund purchase price in full.

If Buyer decides, within 3 months of purchase date, that they are not satisfied with the dog, dog must be returned to Seller. A partial refund will be given providing the dog is mentally, physically, and emotionally sound.   No refund will be given if Buyer did not comply with breeder’s requirements for successful companionship (socialization, care, and training).  Under no circumstances will a refund be given because the dog did not fall into a certain size category or coat type.  (Although we try to accommodate your cosmetic requests, health and temperament are our first priority.)

The following conditions apply to the sale of the dog named above:

·         The buyer has THREE (3) DAYS from receipt of dog to have dog examined by a Veterinarian.  Any request to return the dog to the seller for a full refund must be made within this time period and may only be requested should the dog prove to be seriously sick upon examination.  Proof of examination must be provided to the seller.  This guarantee will be terminated if dog is not examined within allotted time.
·
         A warranty against all serious life-altering genetic diseases is provided for two (2) years after the date of sale and must be determined by at least two veterinarians.
·         A warranty against debilitating HD (Hip Displaysia) is provided for two (2) years after the date of sale.  The guarantee for HD will be terminated should dog be allowed to become overweight or be involved in any physical trauma that could cause lameness of any time or duration.  Should dog be found to have debilitating HD within its first two years, Buyer must provide Seller with proof in the form of documentation from the Orthopedic Foundation for Animals or from Penn HIP.  We reserve the right to have a veterinarian of our choice confirm the results before replacement or refund is made. If HD is confirmed, buyer is entitled to a replacement pup or a $500.00 refund.
·         Warranties shall apply only to the original purchaser.  Transfer of dog ownership shall void all provisions of this agreement.
·
         Under no circumstances shall Seller be liable to the Buyer or to any third party for a dog that has been subjected to abuse, accident, negligence, or misuse. Also, under no circumstances shall the seller be liable for any consequential, incidental, or special damages resulting from, or in manner related to, the dog itself.
·         Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the buyer.

3. MAINTENANCE
Buyer agrees to maintain the dog in good health, provide routine prevention health care including, but not limited to, inoculation, internal and external parasites and prevention medication (i.e. prevention of fleas/ticks, heartworm, ear mites/infections, etc.).  Veterinary records must be provided to the breeder if requesting refund or replacement.  If any of the above preventative care has not been provided, health warranty will be void. 

Buyer agrees to provide proper indoor shelter and socialization for dog. (The dog is meant to be a human/family companion and needs to be treated as such to maintain physical and mental well-being.) 

Buyer agrees to feed the dog quality dog food made specifically for large breed dogs.

Buyer agrees to keep the dog’s coat brushed regularly and free of excessive matting.  Buyer also agrees to employ the help of a professional groomer, if needed, to keep the dog and his coat healthy and manageable.

 Buyer agrees to have dog spayed or neutered by the age of one (1) year.  Buyer must send seller proof of spay/neuter in writing from the operating veterinarian.  Upon receiving proof within one (1) year of the whelping date, Seller agrees to refund $50.00 of purchase price to the Buyer.  If buyer does not comply with this agreement, warranty is void.

Buyer agrees that dog will not, under any circumstances, be taken to a shelter.  If buyer decides at any time that he or she is unhappy with the dog, Seller must be contacted first.  Seller agrees to assist with re-homing the dog.  If necessary, and dog is under the age of two (2) years, dog may be returned to the seller at buyer’s expense until a home can be found.

4. FULL AND FINAL AGREEMENT
The parties agree that this writing represents the entire agreement between them and that no other representations, either oral or written, have been made regarding the dog described above.  The parties further agree that no changes in this contract shall be binding upon either of them without written modifications signed by both parties.

Buyer agrees that he/she understands this contract fully.
